Issue Overview

The purpose of this section is to provide information and boilerplate language that will help to provide a basic understanding of the issue by factually describing the issue, its scope, and dimensions.

Counties may host commercial recreational opportunities for guides and outfitters. Accordingly, most of these commercial entities must be properly certified to provide a safe and satisfying experience for potential customers.

Options & Trade-Offs

While there may be a broad array of opportunities for commercial guides and outfitters, Utah State Parks has statutory responsibility for the testing, certification, and permitting of commercial river guides and vessel operators in Utah . State parks is also responsible for the state registration of boating outfitter companies transporting individuals for hire on rivers, and is primarily responsible for enforcing the state requirements and responsibilities of boat livery (rental) operations in Utah. Counties with operators/outfitters transporting individuals for hire on lakes and rivers, and boat liveries should contact the Utah Division of Parks and Recreation for state regulations and assistance with planning efforts.

Desired Future Condition

The purpose of this section is to provide information and boilerplate language that will help to describe the improvements and changes that need to be made to the existing condition in order to achieve the desired future condition. It also provides the basis for the development of policy statements that support the desired future condition.

Range of Alternatives

The county should ensure that commercial guides and outfitters adhere to stated policies, procedures and regulations. This will require a strong cooperative effort between the county and all agencies with a regulatory or jurisdictional stake in these activities. Clear lines of communication, an understanding of applicable laws, regulations or permits, and good interagency working relationships will ensure more effective and efficient management of commercial guides and operators. As statutory responsibility falls upon Utah State Parks in the testing, certification and permitting of commercial river guides and vessel operators , State Parks is willing to consult with the county over these issues. Likewise, counties may consult with State Parks regarding the registration of boating outfitter companies transporting individuals for hire on rivers, and the enforcement of state requirements and responsibilities of boat livery (rental) operations in Utah.
